This webinar will provide an overview of managing per- and polyfluoroalkyl substances (PFAS) risks in transactions, covering topics such as brownfields developments, Phase 1 and Phase 2 assessments, and strategies for addressing risk through insurance products and indemnification and other provisions in transactional documents. It will also address cleanup standards, as well as emerging issues related to PFAS in permitting.

Panelists will address available testing methods; PFAS and government guidance on testing and treatment; and the role of privilege in internal risk assessment and risk management programs.

Insurance and PFAS

March 19, 2025

This webinar offered ways to mitigate exposure to per- and polyfluoroalkyl substances (PFAS) risks through insurance. Panelists discussed how to assess the risk and review the insurance-related implications triggered by PFAS exposure and present different insurance coverage options to protect against losses stemming from enforcement or lawsuits for alleged PFAS contamination. They also addressed recent strides taken by insurers to enact PFAS-specific exclusions that would carve out coverage for PFAS-related issues.
